A warehouse supervisor with six years’ service was dismissed after a run of missed safety checks. ACAS early conciliation had ended without agreement by the time the company called us, and the former supervisor’s representative had said a claim would follow. The managers were sure the dismissal was justified. The paperwork was thinner than their memory of it: two of the four warnings had been given in conversation and never confirmed in writing, and the appeal had been heard by the manager who made the decision. The claimant’s schedule of loss put the claim at £38,000.
Amara and Hana met the operations director and the two managers in the first week and built a chronology from rotas, emails and the safety log, not from recollection. That record showed the missed checks were real and documented, which was the company’s strongest point, and it showed exactly where the procedure had fallen short.
The company’s response to the claim went in well inside the tribunal’s deadline. At disclosure we exchanged the safety log in full, which narrowed the argument to the fairness of the process. Once the hearing was listed, we set out in writing the realistic range of outcomes at a hearing, including the cost of four days of managers’ time in the tribunal, and made a without prejudice offer through ACAS.
The claim settled on 1 October 2025, two weeks before the hearing, for £14,000, a little over a third of the claimant’s schedule of loss, with no admission of liability, recorded on an ACAS COT3. The company now uses a two-page disciplinary procedure we wrote with its managers. Every warning is confirmed in writing within two working days, and appeals go to a director who was not involved in the decision.
We knew where the case stood every week, and we knew the cost before we agreed to anything.
